Harris to inherit $240M in Demfunds if Biden drops out — transfer tricky for other candidate

 Kamala Harris is poised to take Joe Biden’s place if he drops out of the presidential race — in part because she’s the only person who can take control of the Democrats $240 million war chest, sources told The Post.

Many prominent Democrats are waiting in the wings to take the ailing 81-year-old’s place, but the quarter billion Biden-Harris have raised is non-transferrable, campaign finance sources told The Post.

“Biden has two real choices: Kamala inherits; or they transfer it all to the DNC,” Signum Global partners Rob Casey told The Post. “That money would all be accessed by Kamala… anyone else would be on their own for fundraising.”

Even if Biden wanted to, campaign finance sources say giving the money to another candidate — like California governor Gavin Newsom or Michigan governor Gretchen Whitmer, whose names have been mentioned as possible replacements — would prove sticky.

That’s because only Biden and Harris are named in the federal paperwork for the campaign which donors gave money to, which amounts to the lion’s share of the money raised. 

Legal sources note Biden, like every other individual, is still subject to campaign finance laws that cap donations at $3,300 to each candidate in a general election. Even the DNC is limited to just a $5,000 contribution to each candidate.

And some Democrats told The Post it’s a “tragedy” that even if it were Kamala on the ballot, they’re stuck with a candidate “no one wanted,” a source told The Post.

“The tragedy for the Democrats is they were so focused on identity politics they picked someone no one wanted who checks a box,” one Democratic donor close to the situation told The Post.

“Had they focused on performance politics they would be in a terrific situation… but I don’t think she can win.”

On a Sunday call with donors the campaign said, in the event of Biden stepping down, the fund would be directed to Harris.

Following Biden’s disastrous, bumbling debate appearance last week, a CNN poll showed Harris having a slightly better chance of beating Donald Trump if she went head-to-head against him rather than Biden. Harris won over 45% of registered voters in the poll if she went against Trump, while only 43% picked Biden. 

While Biden has been insistent he will remain at the top of the ticket, Democratic sources acknowledge the campaign needs to prepare for anything — especially as a growing chorus of notable Democratic lawmakers begin to call for his ouster.

And by nature of the staggering sum in the campaign coffers, putting Harris at the top of the ticket would be the simplest option, these people add.

If Biden and Harris both decided to exit the race, it’s possible that money could be transferred to the Democratic National Committee.

Rather than trying to move the funds somewhere, candidates always have the option to simply reimburse donors as well.

Biden’s campaign says it raised $127 million in June, its best month on record for the re-election campaign, according to CBS, which also noted it is spending around $50 million a month on ads.   

However, the outlet noted the Trump campaign and Republican National Committee raised more money than then in April and May and have yet to release their total for June.

Additional money for any Democrats who challenge Biden can be taken from Political Action Committees (PACs). Unlike official campaigns, where a candidate has discretion over the money, cash from PACs are relatively easy to transfer, sources told The Post.

“PACs don’t have a board so PAC money can go to anyone,” Republican fundraiser Caroline Wren said.

Future Forward — the unofficial political action committee raising money for Biden — has north of $200 million according to campaign filings in January. However, they have also announced plans to spend $250 million on ad buys between the Democratic Convention and the election in November so it’s unclear if all their money is spoken for.

But Democratic sources say this goes beyond just money. “As sitting vice president, Harris is the natural choice to assume leadership,” Casey adds. “Politically she is the highest-ranking Democrat and procedurally she would likely inherit delegates and Biden’s backing.”

However, sources also noted that were Biden to drop out at such a late stage in the election process it would be such an unprecedented move that there’s little way to tell exactly how it would be handled and what would happen, regarding funds collected or the new nominee.

25 House Democrats reportedly preparing to call for Biden to end re-election effort

 President Biden may soon face increased pressure from Democrats in Congress to drop out of the 2024 race, according to a report.

At least 25 House Democrats are preparing to call for the 81-year-president to end his re-election bid in the wake of his disastrous debate against former President Donald Trump, Reuters reported Tuesday, citing a House Democratic aide.

Centrist House Democrats in competitive districts – the lawmakers most at risk of losing their seats in November – were so alarmed by Biden’s infirmed appearance in last week’s showdown with the 78-year-old presumptive Republican nominee that they are considering writing a letter to Biden, according to the outlet.

The report comes after Rep. Lloyd Doggett (D-Texas) became the first House Democrat to call on Biden to step aside over his shaky debate, in which the president repeatedly froze up on stage and lost his train of thought.

Rep. Jared Golden (D-Maine), also on Tuesday, expressed that he had no confidence in Biden’s ability to beat Trump in November.\

As did Rep. Marie Gluesenkamp Perez (D-Wash.), who told local outlet KATU, “The truth I think, is that Biden is going to lose to Trump.”

“I know that’s difficult, but I think the damage has been done by that debate,” she added, stopping short of calling on Biden to drop out of the race.

Biden is expected to meet with Democratic state governors on Wednesday to discuss his 2024 strategy and his debate performance with Trump. 

The White House also indicated that meetings between Biden and congressional leaders were in the works as well. 

The offices of multiple House Democratic leaders did not respond to The Post’s requests for comment.

US northern border is massive loophole for Biden asylum ‘crackdown’ — crossings hit new record

 President Joe Biden has a 5,500-mile loophole in his border crackdown.

The US-Canada border — the longest in the world — remains wide open for migrants seeking to enter the country illegally and claim asylum because it’s not part of the Biden administration’s latest restrictions, sources told The Post.

Without the same restrictions as the southern border, a record 3,600 migrants entered illegally in June — more than recorded crossings for all of 2022, according to leaked Homeland Security data obtained by The Post.

“The executive order doesn’t affect us,” a Border Patrol source at the northern border told The Post.

“Family units are getting released and singles are sent to detention for adjudication.”

Even with Biden’s asylum restrictions on the southern border, the administration allowed in more than 100,000 migrants in June, according to The Post’s recent analysis of leaked Homeland Security data.

The policy is meant to bar asylum access to migrants who enter illegally until such crossings fall below an average of 1,500 per day. It does, however, offer a multitude of exceptions.

Meanwhile, the northern border has become an opportune place for migrants trying to enter the US illegally in recent years as the area has few barriers and fewer border agents, DHS sources told The Post.

The surge in illegal crossings at the US-Mexico border has also pulled resources from the northern border, including agents who have been moved to help interview migrants caught down south via video conference calls.

Border agents have also been physically deployed south to temporarily help their colleagues process migrants over the last three years.

The Swanton sector — which covers New York, Vermont and New Hampshire —  has seen become the number one area in the northern border for illegal crossings and has seen migrants coming from 85 different countries since October.

Between October and May across the entire northern border, agents also saw thousands of migrants coming from India and Latin America.

The Post recently got an inside look into how Americans living in the region have seen migrant smuggling operations unfolding on their properties.

“Now I’ve got the Border Patrol guys on speed dial,” local Chris Feeley, 52, told The Post in February.

Feeley said he has watched from his hunting tree-stand as migrants crossed his property openly over the last three years.

In one instance, he noticed startled deer run by before two men “of Mexican descent” wearing backpacks and carrying walking sticks followed.

“He stopped right underneath me and was looking at his iPhone and was following a trail, so obviously somebody gave him a route of which way to go,” said Feeley, who now carries a firearm on his own property.

“I was just stunned, I didn’t know what to do. I just let them walk off, I gave them 10 minutes before I went back to the barn to call Border Patrol.”

The region has also had more terror watchlisted individuals attempting to cross via ports of entry, with more than 198 caught between October and May — and 484 in the previous financial year, according to federal data.
