Cartels Have Operational Control Of US Border, 'Terrorizing' US: Rep. Chip Roy

Mexican cartels are making billions of dollars from drug trafficking, human smuggling, and exploiting the U.S. border, said Rep. Chip Roy (R-Texas).

Border Patrol agents apprehended more than 1.3 million illegal immigrants crossing into Texas from Mexico in 2021. Hundreds of thousands more weren’t captured. Seizures of the deadly synthetic opioid, fentanyl, have sharply increased, as have overdose deaths in the United States.

“We have 100,000 Americans die from opioid poisonings. They’re not really overdoses—they’re poisonings,” Roy told NTD’s Capitol Report on Jan. 28.

“China is moving it through Mexico, cartels are making money, China is getting empowered, America’s getting hammered—all because this administration refuses to do its job of securing the border.”

The chemicals to make fentanyl are produced in China and shipped to Mexico, where counterfeit pills are manufactured, heroin is spiked, and other products are laced before being sent across the southern border.

U.S. Customs and Border Protection reported a 1,066 percent increase in fentanyl seized at south Texas ports of entry during fiscal year 2021.

The cartels, which fight over the lucrative territory that abuts the United States, have expanded their reach, profits, and power through a massive increase in human smuggling and trafficking over the past year.

They often send large groups through in one area of the border to tie up Border Patrol resources, which leaves nearby areas unpatrolled and open for illicit transport, said Rodney Scott, former U.S. Border Patrol Chief.

“They simply overwhelm agents with those massive numbers, and that creates other areas where there’s no law enforcement at all,” Scott told Capitol Report on Dec. 16.

“That’s where they’re bringing the narcotics, the criminal aliens, the people that want to avoid arrest, for whatever reason, and they’re just pouring across at will. This is a crisis and it is real.”

Illegal immigrants have to pay a cartel to cross into the United States, and the amount varies on the country of origin and the destination in the United States. Often, the illegal immigrant doesn’t have the money and will enter the United States indebted to the cartel.

“These are human beings. They are put into the labor or sex trafficking trade and they’re basically held as slaves to enrich the worst elements of our society—cartels, but also just illegal illicit organizations that are perfectly happy to use the cartel network to get the people that they’re going to abuse. It’s absolutely horrific,” Roy said.

“One boy thought he was paying $4,000 to go pick grapes in California. Instead he was going to be held for ransom in a stash house in Houston.”

Recently, eight illegal immigrants were discovered in a vehicle in Boerne, Texas, just north of San Antonio.

“The driver of the car was an American citizen employee of one of those cartels, moving those eight people—two of whom were bound in the trunk—heading to a stash house in Houston,” Roy said.

“How is the most powerful nation in the history of the world allowing our borders to be operationally controlled by cartels, while Democrats pat themselves on the back for compassion, using asylum as an excuse for wide open borders that do nothing good for the American people?”

Roy has introduced a bill that seeks to designate two cartels as terrorist organizations in the last two congressional legislative sessions.

The bill directs the State Department to designate the Reynosa/Los Metros faction of the Gulf Cartel and the Cartel Del Noreste faction of Los Zetas as foreign terrorist organizations. It also requires the state department to produce a report on those cartels, as well as any others that meet the criteria.

The bill has the support of 45 co-sponsors, all Republicans. But he’s not confident it will get passed during Biden’s administration.

“They don’t give a rat’s rear end about securing the border or trying to go after cartels,” Roy said. But the bill also faces opposition from some Republicans.

“You have some Republicans who hand-wring and go, ‘Well, you can’t call them cartels, because you elevate them to something that’s the same as the Taliban, or Al-Qaeda, or ISIS,” Roy said.

“But to me, they are terrorizing the United States, they’re terrorizing people in Mexico. They’re doing it purposely, they’re doing it for political power, they’re doing it to enrich themselves.

“They hang people, they bury people alive. They kill people and send videos to their families, so that they can terrorize people.”

Roy said the United States needs to go after the cartels and reclaim operational control of the southern border.

Meanwhile, he’s preparing to impeach Department of Homeland Security Secretary Alejandro Mayorkas for dereliction of duty.

Canadian Official 'Expects Police To Take Appropriate Action' As Convoy Blocks US-Canada Crossing

 Update (1550ET): At least 100 truckers are blocking the Canadian border between Alberta and Montana for a third day in protest of vaccine mandates - and Canadian officials are beginning to freak out.

On Sunday, Alberta Premier Jason Kenney called for an end to the blockade, saying in a statement: "Canadians have a democratic right to engage in lawful protests. I urge those involved in this truck convoy protest to do so as safely as possible, and not to create road hazards that could lead to accidents or unsafe conditions for other drivers."

According to the Calgary Herald, over 100 vehicles remain blocking the Southern Alberta highway.

Semi-trucks, cars and farm equipment filled Highway 4 south of Lethbridge on Saturday, in support of a national convoy to Ottawa with a stated goal of repealing a federal mandate requiring unvaccinated Canadian truckers re-entering Canada from the United States to get tested for COVID-19 and to quarantine. Some participating in both protests have expanded that goal, demonstrating against health orders and the federal government as a whole. -Calgary Herald

And it looks like Canada officials may be about to take action.

"If participants in this convoy cross the line and break the law, I expect police to take appropriate action," said Kenney.

Kenney has previously warned that vaccine restrictions could disrupt the supply chain between the US and Canada.

The truckers, meanwhile, have voted to stay.

Canadian Prime Minister was accused of hypocrisy when he suddenly was nowhere to be found late last week as a convoy of truckers rolled into Ottawa to protest the government's COVID mandates. Many scoffed at Trudeau's sudden disappearing act when confronted by a massive crowd of protesters, many carrying signs mocking his comment that the truckers and their supporters were part of a "tiny fringe minority".

Making matters worse for the PM, Canadian media reported Monday morning that Trudeau had been diagnosed with COVID, despite receiving a booster dose early this month on Jan. 4.

The truckers are protesting a new measure imposed by the Canadian government on Jan. 15 requiring unvaccinated cross-border truckers to quarantine upon returning home, making it virtually impossible for them to work. The convoy ended outside Parliament in Ottawa over the weekend, as thousands of protesters gathered.

Trudeau had reportedly decided to isolate due to one of his children testing positive for COVID. Now it appears he too has tested positive. Of maybe this is just another excuse for him to remain in hiding?

Former President Trump praised the Canadian truckers over the weekend, proclaiming that they were doing more to protect American freedoms than any lawmakers.

According to his own quarantine requirements, Trudeau now has an excuse to remain in hiding for up to 14 days.

Small US Firms Hammered As Biden's Free-N95-Mask-Handout Benefits Big Producers Only

Many U.S. residents will be able to find free masks at local retailers, pharmacies, and community health centers over the next few weeks following the federal government’s deployment of 400 million N95 masks to the general public from the Strategic National Stockpile.

Two days after the Biden administration launched the program on Jan. 19, large retailers such as Hy-Vee, Walmart, and Meijer made the N95 masks available online, according to Jeffrey Zients, White House Coronavirus Response Coordinator, at a Jan. 26 teleconference.

“Americans will be able to pick up free masks, as I said earlier, at tens of thousands of convenient sites, including, as you mentioned, community health centers around the country and local pharmacies,” Zients said, adding that the program will hit full strength “across the next couple of weeks.”

The announcement came after the Centers for Disease Control and Prevention (CDC) updated masking recommendations by encouraging Americans to wear medical-grade N95 or KN95 masks previously prioritized for health care workers due to supply shortages.

Loosely woven cloth products provide the least protection, layered finely woven products offer more protection, well-fitting disposable surgical masks and KN95s offer even more protection, and well-fitting NIOSH-approved respirators (including N95s) offer the highest level of protection,” the CDC stated on its website.

Following President Joe Biden’s mask announcement, small U.S. mask-makers reported a 70 to 80 percent decline in N95 sales, the American Mask Manufacturer’s Association (AMMA) told The Hill on Jan. 26.

“We absolutely support that the Biden administration is helping get high-quality masks on people’s faces quickly, but there is an unintended consequence to that action and we’re hoping that it’s followed up with purchases based on President Biden’s Buy American order,” said AMMA Chairman Brent Dillie.

To replenish the nation’s emergency stockpile of 750 million N95 masks, the Biden administration plans on signing contracts with domestic manufacturers that can produce 141 million N95 respirators per month, according to Dawn O’Connell, assistant secretary for preparedness and response at the Department of Health and Human Services.

This means that small mask producers are likely to miss out on the deal, with only the largest domestic manufacturers, like 3M Co. and Honeywell Inc., being able to make the cut.

Walgreens, which is one of several chains rolling out the masks, has begun giving away N95 masks at selected pharmacies, according to NBC, with a limit of three per person.

All Walgreens pharmacies are anticipated to receive N95 masks by mid-February according to a statement.

Meanwhile, all 275 Hy-Vee pharmacy branches will receive their mask allocation by the middle of the week starting Jan. 31, a company spokeswoman told NBC.

Meijer, which told NBC that it has been allocated 3 million masks, began giving them out on Jan. 24.

I Have Long COVID. Do I Qualify for Disability Insurance?

Not everyone known as a COVID “long-hauler” will qualify for disability insurance. But it’s important to document your symptoms and make your best case, because long COVID could prevent you from earning money. 

Here, we break down what you should know about the evolving standards for disability insurance for long COVID compared with other conditions.

What is long COVID?

Long COVID can occur in anyone who has had COVID-19, regardless of the severity of illness, age, or gender. A recent FAIR Health study of nearly 2 million individuals with COVID-19 found that about 23% of them continued to have at least one COVID-19 symptom 30 days or more after their diagnosis.

The Centers for Disease Control and Prevention (CDC) identifies the following as some long COVID symptoms:

  • Difficulty breathing or shortness of breath

  • Tiredness or fatigue

  • Symptoms that get worse after physical exertion

  • Difficulty thinking or concentrating (“brain fog”)

  • Cough

  • Chest or stomach pain

  • Headache

  • Fast-beating or pounding heart

  • Joint or muscle pain

  • Pins-and-needles feeling

  • Diarrhea

  • Sleep problems

  • Fever

  • Dizziness on standing

  • Rash

  • Mood changes

  • Change in ability to smell or taste

  • Changes in menstrual cycle

Health problems that persist for 4 or more weeks after COVID-19 infection could be long COVID. The duration of long COVID is still unknown.

Is long COVID a disability?

Yes, long COVID can be considered a disability. The civil rights arms of the U.S. Department of Health and Human Services and Department of Justice have both determined that long COVID is a disability

If your post-COVID symptoms substantially limit your ability to do one or more life activities, the  Americans with Disabilities Act considers it a disability. Examples of potential life activities affected include:

  • Walking 

  • Dressing 

  • Speaking 

  • Eating 

  • Sleeping

The U.S. Equal Employment Opportunity Commission recognizes this definition and provides workplace protections for those with long COVID. 

If your long COVID symptoms aren’t being relieved and are affecting your ability to work, document what is happening and start the process of applying for assistance right away, said

Lynn Blewett, professor of health policy and management at the University of Minnesota School of Public Health and director of the State Health Access Data Assistance Center (SHADAC).

If you’re concerned about job loss, contact an insurance navigator or health insurance exchange broker to maintain your healthcare coverage, she said.

Ask your human resources department about options like short- and long-term disability, the Family and Medical Leave Act (FMLA), and contact the Social Security Administration to start applying for assistance, Blewitt said. If you know —  and can show — you acquired COVID-19 because of your job, ask about workers’ compensation.

Does SSDI cover people with long COVID?

You’re eligible for Social Security Disability Insurance (SSDI) if you can’t work and your illness is expected to last for at least one year or result in death. Social Security is funded by the Social Security taxes that your employer takes out of your paycheck. 

“Make sure that you have documentation from your doctor in terms of your conditions and your physical and mental impairment. To receive disability payments, it has to be medically determined that that impairment is going to last at least 12 months,” Blewett said. 

If you are eligible for SSDI and long-term disability, your long-term disability payments will be reduced by the amount of SSDI you get.

Contact the Social Security Administration at 1-800-772-1213 to ask about disability insurance, or use its online benefit-eligibility tool.

SSDI has a 5-month waiting period before you can begin receiving benefits. After 2 years on SSDI, you can receive Medicare, regardless of age. The application process for SSDI alone can take up to 5 months, so it’s important to start as soon as you can.

Many advocacy groups such as Stopthewait.org are pushing for changes to these waiting periods. In an open letter to Congress, the Stop The Wait Coalition writes, “These exclusion periods are fundamentally unfair; they delay people from seeking treatment and eventually returning to work, and they prevent people from accessing the insurance for which they paid.”

People getting SSDI have to wait 2 years for Medicare benefits unless they have end-stage renal disease (ESRD, or permanent kidney failure) or amyotrophic lateral sclerosis (ALS or Lou Gehrig’s disease). With ESRD and ALS, there is no waiting period.

Does workers’ compensation cover people with long COVID?

The National Council on Compensation Insurance (NCCI) says “maybe.” Workers’ compensation laws provide compensation for “occupational diseases” directly related to the job — think firefighters and lung disease — but in many states, routine sicknesses like the common cold and flu are not covered. 

In most cases, it’s too difficult to prove that an employee acquired a communicable disease through the workplace, said Jeff Eddinger, senior division executive at NCCI. But COVID-19 is unique in that it can be eligible for compensation. 

“If you have contracted COVID-19 on the job, or as part of the job, then you are likely covered by workers’ compensation,” Eddinger said.

He noted that anyone eligible for workers’ compensation for COVID-19 would also be eligible for compensation for long COVID.

Coverage applies regardless of when you report your illness, as long as you can meet your state and company’s “burden of proof” by showing that it was work-related. 

Because of COVID-19, many states have extended workers’ compensation benefits for COVID-19 for certain professions. For healthcare workers, first responders, and essential workers in some states, if you get COVID-19, it is now presumed that you acquired it through work.

The National Conference of State Legislatures (NCCI) reports that 17 states and Puerto Rico recognize COVID-19 as a work-related illness and provide workers’ compensation

As of June 2021, the NCCI found that nearly 75% of reported COVID-19 workers’ compensation claims had come from healthcare workers and first responders. 

Do short-term and long-term disability cover people with long COVID?

If long COVID is preventing you from working, and your recovery window is unclear, short-term disability may give you enough time to recuperate while preserving your job and health insurance, Blewitt said. Short-term disability provides you with a portion of your paycheck and can last anywhere from a few weeks to 2 years. Payments typically begin right away. Benefits are typically 60% to 75% of your base pay. The median pay rate is 60% of salary.

Long-term disability (LTD) plans can provide pay for a few years, or until the disability ends. All plans have waiting periods before payouts begin and typically work in sync with short-term disability. Most waiting periods are 3 to 6 months. LTD typically pays about 60% of annual earnings.

Unlike the FMLA, disability policies don’t provide job protections. But both short- and long-term provide income more quickly than SSDI can. While employees pay into their Social Security benefits, few pay into short- or long-term disability.

Should I look into private disability insurance if I am at risk for COVID-19?

Individuals can buy private disability insurance and should shop around if they are concerned they may need it, Blewitt said. 

There are four key questions to ask insurance companies, according to Usa.gov:

  • How does the policy define disability?

  • When do benefits begin?

  • How long will the benefits last?

  • How much money will the policy pay?

Does FMLA apply to people with COVID-19 and long COVID?

If you have been at your job for 12 months or longer, you could qualify for the Family and Medical Leave Act (FMLA). It requires certain employers to provide employees with unpaid leave for specific family and medical reasons. If you have a serious health condition or need to care for someone with one, ask human resources about your FMLA benefits. Although the 12 workweeks of leave it provides annually are unpaid, it preserves your health benefits and protects your job.

FMLA doesn’t protect employees who elect to stay home to avoid getting COVID-19.

The bottom line

If your post-COVID symptoms are interfering with your life, don’t wait to ask for help. Talk to your healthcare provider, document your mental and physical symptoms, and contact the Social Security Administration to begin the application process for disability benefits. Contact your human resources department at work to explore options such as FMLA, and short- and long-term disability insurance.

Warren secures ethics concessions from Biden FDA pick

 President Biden's nominee to lead the Food and Drug Administration (FDA) made significant ethics concessions to Sen. Elizabeth Warren (D-Mass.) in an effort to secure Democratic votes ahead of his confirmation.

In a letter to Warren, Robert Califf committed not to seek employment or compensation from any drug or medical device companies he interacts with as commissioner for four years following his tenure if confirmed.

"I intend to pursue opportunities in higher education to help educate the next generation of medical leaders. I have, and always will be, a physician and researcher first," Califf wrote in a letter dated Jan. 27. 

Califf also committed to recuse himself from matters involving his former employers and clients for four years, two years longer than what is required in the Biden-Harris administration’s ethics pledge.

“The Biden-Harris Administration has set the highest ethical standards of any Administration for its political appointees,” Califf wrote. “However, in response to your letter, I am willing to voluntarily extend the recusal period from two years to four years for all particular matters involving companies with which I have a previous working relationship.” 

Califf also agreed to recuse himself from all matters before the FDA involving Duke University, which he retired from in 2019. 

"I believe it is important to reassure the public at the outset that the previous positions will not bias or influence any of my decision making on behalf of the agency," Califf wrote. 

Califf previously served as FDA commissioner in 2016 at the end of the Obama administration. Since he left government, Califf has advised Google Health and its spinoff, Verily Life Sciences. Warren previously expressed concern about Califf's $2.7 million paycheck for advising Verily. 

In a statement, Warren Califf "has demonstrated a strong commitment to avoiding conflicts of interest and closing the revolving door between FDA and the industries it regulates."

A spokesperson for Warren said the senator plans to support Califf if his nomination comes to a vote.

In 2016, Califf was easily confirmed by a vote of 89-4, but it's not clear he has enough support among the 50 senators needed.

At least five Democratic senators have said they would oppose Califf due to concerns over his industry ties and track record on regulating opioids, and anti-abortion groups are pressuring Republicans to oppose him as well.

Califf advanced through the Senate Health Committee by a 13-8 vote earlier this month.
