"There Is No Crime": Dershowitz Says Bragg’s Case Against Trump Will Fail

Retired Harvard law professor Alan Dershowitz said on April 28 that he believes that Manhattan District Attorney Alvin Bragg’s case against former President Donald Trump could fail because prosecutors have charged the former president with fake crimes.

There is no crime,” Mr. Dershowitz said during an interview on Fox News on April 28, referring to the case in which Mr. Bragg’s office has charged the former president with 34 counts of falsifying business records to hide so-called hush money payments that prosecutors allege amounted to a criminal conspiracy to influence the 2016 presidential election.

Mr. Dershowitz argued that making nondisclosure payments is not a crime and that neither is paying for the non-publication of potentially embarrassing stories (the so-called catch-and-kill dimension of the case), both of which prosecutors have alleged were part of a conspiracy to sway voters.

The retired law professor argued that Mr. Bragg’s office is in danger of having the case thrown out on grounds similar to those on which the conviction of Harvey Weinstein was recently overturned, namely that prosecutors prejudiced the case by a number of “egregious” improper rulings, including allowing testimony that was unrelated to what Mr. Weinstein was charged with.

They ought to be very careful about this because the Supreme Court of the Appellate Court in Albany just reversed Harvey Weinstein’s conviction on the ground that they put in too much information that wasn’t really relevant to the case,” Mr. Dershowitz said, adding that this is “what’s happening” in the trial against President Trump.

“There is no crime in Manhattan. You cannot figure out what the crime is. That’s why they’re putting on all this evidence of non-crimes,” Mr. Dershowitz said.

“Trying to persuade the jury that ‘catch-and-kill’ is a crime—it’s not. Paying hush money is a crime—it’s not. Putting a corporate statement is a misdemeanor barred by the statute of limitations. You can’t suddenly resurrect that and turn that into a crime by invoking a federal statute which the federal government refused to invoke—the Federal Election Commission refused to invoke.”

The former Harvard law professor has repeatedly criticized Mr. Bragg for elevating the charges against President Trump from misdemeanors to felonies on what Mr. Dershowitz has argued was an invalid legal premise because the Manhattan district attorney invoked federal statutes over which New York has no jurisdiction.

Republicans have accused Mr. Bragg of bringing the case against the former president for political reasons.

Mr. Bragg’s office did not respond to a request for comment.

‘Destruction of America’s Rule of Law’

Mr. Bragg indicted President Trump on 34 counts of allegedly falsifying business records in order to conceal $130,000 in payments to adult film actress Stormy Daniels in exchange for keeping quiet about her allegations of an affair she had with President Trump.

President Trump has maintained his innocence and has denied the affair.

“There is no case here. This is just a political witch hunt,” the former president said before court in brief comments to reporters on April 25.

Under New York state law, falsifying business records is a misdemeanor. However, if the records fraud was used to cover up or commit another crime, the charge could be elevated to a felony, though a number of legal experts—including Mr. Dershowitz—have challenged the way that has been done in this case.

“In order to turn the state statute into a felony, you have to borrow a federal statute,” Mr. Dershowitz told The Epoch Times in March 2023. He said that this combining of laws “seems to raise real serious legal questions.”

“In Bragg’s case, what they’re trying to do is add one and one and come up with 11,” Mr. Dershowitz said. “No rational person would look at these two statutes and say that Trump violated them.”

The prosecution’s first witness in the case was former National Enquirer publisher David Pecker. Prosecutors alleged that he participated in a catch-and-kill scheme to suppress unflattering stories about President Trump and help him get elected.

President Trump’s attorney, Todd Blanche, said in court that the catch-and-kill that the jury heard about from prosecutors was not part of the charges against the former president because it was not illegal and happens regularly.

“The reality is that there is nothing illegal about what happened,” Mr. Blanche argued. He added that testimony would be about things from 2015 to 2017 and asked the jury to “think about whether it rings true and whether what they’re saying is accurate.”

Use your common sense. We’re New Yorkers; that’s why we’re here. You told the court you would put aside whatever view you have about President Trump, the fact that he’s running,” he said. “If you do that, there will be a very swift non-guilty verdict.”

Mr. Dershowitz has said in the past that he believes that New York prosecutors are violating voters’ rights with the case, alleging that the law is being “abused for partisan political purposes and to constitute election interference.”

The former law professor went further in his remarks on Fox News on April 28, arguing that the case is about whether basic civil liberties are protected or undercut.

“If it’s Donald Trump today, they can go after you tomorrow, and your relatives tomorrow, for something that isn’t a crime,” he said.

“That’s why every American, whether you’re a Democrat or Republican, should be opposed to what’s going on in that Manhattan courtroom.

“It’s a scandal and it’s a destruction of America’s rule of law.”

Eliem Shifts From Neurology With New Focus On Autoimmune With Tenet Medicines Deal

 Eliem Therapeutics Inc (NASDAQ:ELYM) has agreed to acquire Tenet Medicines Inc., a development-stage private biotechnology company.

The combined company plans to focus on advancing TNT119, an anti-CD19 antibody designed for a broad range of autoimmune diseases, including systemic lupus erythematosus, immune thrombocytopenia, and membranous nephropathy.

In June 2023, Eliem Therapeutics completed a review of its business, including the status of its programs, resources, and capabilities. The company has decided to halt further development of its Kv7 program and comprehensively explore strategic alternatives.

Also, Eliem entered a securities purchase agreement for a $120 million private placement. Eliem has agreed to sell 31.2 million shares at $3.84 per share.

The private placement is expected to close concurrently with the closing of the acquisition anticipated in mid-2024.

The combined company’s total cash and cash equivalents are expected to be approximately $210 million.

Eliem expects this will be sufficient to fund the combined company’s planned operations into 2027 and to enable the potential attainment of key clinical and development milestones for TNT119.

“The Eliem board of directors has conducted a thorough review of strategic alternatives, and we believe the transaction we are announcing today with Tenet presents a compelling opportunity for our stockholders,” said Andrew Levin, Executive Chairman of Eliem. “We believe TNT119 represents a promising clinical asset across multiple autoimmune diseases targeting markets where there is a need for improved treatment options.”

Pre-acquisition Tenet equity holders are expected to own approximately 15% of the combined company, and pre-acquisition Eliem equity holders are expected to own approximately 85%.

Cyclacel drops plan for more stock

 Cyclacel Pharmaceuticals (NASDAQ:CYCC) stock is rocketing higher on Tuesday after the clinical-stage biopharmaceutical company withdrew a proposed public offering.

A filing with the Securities and Exchange Commission (SEC) shows that Cyclacel Pharmaceuticals is withdrawing its proposed public offering filed in March. The company notes that its filing fees won’t be refunded but seeks to have them applied to future filings.

Here’s a portion of what the company said in its filing with the SEC withdrawing the offering:

“The Company has determined not to pursue, at this time, the public offering to which the Registration Statement relates. The Registration Statement has not been declared effective by the Commission and no securities have been issued or sold under the Registration Statement. Accordingly, withdrawal of the Registration Statement is consistent with the public interest and the protection of investors, as contemplated by paragraph (a) of Rule 477.”

"Risk of bird flu spreading to cows outside US, says WHO'

 A World Health Organization official said on Tuesday there was a risk of H5N1 bird flu virus spreading to cows in other countries beyond the United States through migratory birds.

"With the virus carried around the world by migratory birds, certainly there is a risk for cows in other countries to be getting infected," said Wenqing Zhang, head of WHO's Global Influenza Programme at a Geneva press briefing.

She reiterated that the U.N. agency deems the overall public health risk posed by the virus to be low

'Chestfeeding' And Other Transgender Terms Banned In NHS By UK Government

The UK government is updating the constitution of the National Health Service specifically to expunge the creeping effort to ‘transition’ medical language by radical gender ideologists.

The move is being taken to ensure hospitals use language that is medically accurate and based in biological science.

It means that terms such as ‘Chestfeeding’ as a replacement for breastfeeding will be effectively banned.

Referring to ‘people with ovaries’ instead of women will also no longer be considered acceptable.

The Telegraph reports that the Health Secretary, Victoria Atkins, is scheduled to announce the changes this week.

The update will also prohibit biological men from being treated on single-sex female hospital wards in an effort to protect the “privacy and protection” of women and girls in hospitals.

Previously, biological men self identifying as transgender were able to be treated on women’s wards.

As we also previously highlighted, references to women were erased from NHS advice on the menopause, as well as cervical and ovarian cancer.

In addition, Midwives were mandated to use ‘gender-inclusive’ language and issued a list of ‘acceptable’ terms to use when addressing patients, including “mothers or birthing parents”, “breast/chestfeeding” and “maternal and parental.”

Instead of using the term “breastmilk”, they were asked to choose from “human milk” or “breast/chestmilk” or “milk from the feeding mother or parent.”

In 2022, a Freedom of Information Act request revealed that just 29 of the 142 NHS hospitals in England with maternity units still exclusively use the words “woman” or “mother” to refer to pregnancy, while all the others include terms such as “birthing people” or “pregnant people.”

In February it was also revealed that an NHS hospital had claimed drug-induced ‘chestfeeding’ milk produced by biological men who identify as transgender is just as good as natural mother’s milk for babies.

The taxpayer-funded NHS was also found to be spending huge amounts of money asking patients, mostly elderly people, what gender they identify as.

The government changes are aimed at reversing all of this and ensuring it doesn’t happen with other NHS resources.

Maya Forstater, chief executive of the campaign group Sex Matters, described the move as a “major step” on the path to overturning “capitulation to the demands of gender extremists, which has damaged policies and practices, created widespread confusion and harmed patient care”.

“These much-needed changes to the NHS constitution will help secure essential sex-based rights in healthcare across England,” she further asserted, adding “Clear language, single-sex wards and access to intimate care provided by a health professional of the same sex are crucial to the wellbeing and safety of female patients.”

“They should never have been compromised,” Forstater urged.

The development comes after the NHS banned puberty blockers ahead of a major review that concluded the drugs are potentially seriously harmful and the grounds on which they are being used not medically sound.

Last year it was revealed that the number of children placed on puberty blockers for ‘gender affirming care’ doubled in the UK in a year despite the government run body saying it would stop the practice outside of clinical trials.

Trans lobbyist groups, some of them government funded, continue to espouse the virtues of the drugs in their materials, which are being actively used inside schools.

US to test ground beef in states with bird-flu outbreaks in dairy cows

 Federal officials are seeking to verify the safety of milk and meat after confirming the H5N1 virus in 34 dairy cattle herds in nine states since late March, and in one person in Texas.

Both the U.S. Centers for Disease Control and Prevention and the World Health Organization have said the overall public health risk is low, but is higher for those with exposure to infected animals.

Scientists believe outbreaks are more widespread in cows than officially reported based on findings of H5N1 particles in about 20% of milk samples.

The U.S. Food and Drug Administration said on Friday that preliminary results of gold-standard PCR tests showed pasteurization killed the bird flu virus in milk, though.

The U.S. Department of Agriculture will analyze retail ground beef samples with PCR tests that indicate “whether any viral particles are present,” and conduct two other safety studies, according to a statement. Some dairy cows are processed into ground beef when they grow old.

“USDA’s additional testing is appropriate to ensure public health is protected and to stop the spread of animal disease,” said Sarah Little, spokesperson for the Meat Institute, an industry group representing meat processors

USDA on Monday began requiring lactating dairy cows to test negative for bird flu before being moved across state lines as officials seek to contain the virus.

The department said this weekend that testing is not required for cows that are shipped over state lines directly to slaughter facilities from barns where they are sold. Those cattle only need documentation showing they were inspected by a veterinarian.

USDA said it inspects each animal before slaughter, and all cattle carcasses must pass inspection after slaughter to enter the human food supply.

USDA is now also collecting beef muscle samples at slaughter facilities of dairy cattle that have been condemned to determine the presence of viral particles, according to the statement. Any positive PCR tests for retail or slaughter samples will be evaluated for live virus, the USDA said.

Last week, USDA said it had found bird flu in a lung tissue sample from an asymptomatic dairy cow that was sent to slaughter from an infected herd. The animal did not enter the food supply, according to the department.

In another safety study, USDA will cook ground beef containing a “virus surrogate” at different temperatures to assess how it inactivates the virus, according to the statement. It said cooking meat to a safe internal temperature kills bacteria and viruses.

Colombia restricted the import of beef and beef products coming from U.S. states where dairy cows have tested positive for avian influenza as of April 15, according to the USDA.

There are no known cases of bird flu in beef cattle so far.

The human case in the current outbreak was in a Texas farm worker who suffered conjunctivitis following exposure to dairy cows.
