SCOTUS Justice Thomas forces NJ attorney to admit state targeted pro-life group with probe

 Conservative Supreme Court Justice Clarence Thomas got a lawyer for the New Jersey Attorney General’s Office to admit Tuesday it mounted a “fishing expedition” against a pro-life organization without receiving specific complaints about the group.

Thomas drilled down on the investigation of First Choice Women’s Resource Centers during oral arguments in a case challenging a subpoena the organization received from AG Matthew Platkin’s office.

“You had no basis to think that they were deceiving any of their contributors?” Thomas asked Chief Counsel Sundeep Iyer.

“We certainly had complaints about crisis pregnancy centers,” Iyer deflected before admitting none specifically applied to First Choice, a faith-based nonprofit with five facilities across the Garden State that discourages women from terminating their pregnancies.

“We had no complaints,” Iyer said. “But state governments, [the] federal government, initiate investigations all the time in the absence of complaints where they have a reason to suspect that there could be potential issues of legal compliance.”

“I think we had a more than ample basis to initiate this,” he added, citing concerns about misleading donors, unlicensed medical practices, violation of patient privacy, and “potentially misleading or untrue medical statements.”

“Well, that just seems a burdensome way to find out whether someone has a confusing website,” jabbed Thomas.

The 2023 subpoena from Platkin’s office requested that First Choice turn over names of its donors to investigators, alleging that the organization could be defrauding them.

First Choice sued, arguing the subpoena chilled its First Amendment rights.

Platkin’s team countered that First Choice was not yet required to turn over the donor names, but most of the justices were skeptical of the argument against letting the crisis center’s challenge continue.

“You don’t think it might have an effect on future potential donors to the organization to know that their name, phone number, address, etc, could be disclosed as a result of the subpoena?” Chief Justice John Roberts pressed Iyer at one point.

Iyer insisted it wouldn’t and claimed that the closest First Choice got to proving otherwise was a donor declaration that they would have been less “likely to donate … if we had known information about the donation might be disclosed,” which the AG’s office called a “backwards-looking statement.”

“Really? I mean, we’re going to now pick over the tense of the verb that they chose?” exclaimed conservative Justice Neil Gorsuch at Iyer’s rationale.

First Choice attorney Erin Hawley underscored in her argument how potential small donors might be nervous about a subpoena and argued there was nothing misleading about the group’s website.

“If you look at the allegations in this case, some donors gave as little as $10,” she said. “Those folks are going to be worried about a state attorney general getting their names, phone numbers, addresses, places of employment, so that he can contact them about a donor website.”

“I think there is some confusion in the nomenclature here,” Iyer stressed in his argument. “Typically, when we think about subpoenas, we’re thinking about grand jury subpoenas.

“An administrative subpoena is very different, and courts, as a matter of state law, have held across the country that the subpoenas themselves don’t impose any obligation to produce documents.”

Hawley countered that any kind of subpoena could still have a chilling effect.

“That’s not what the face of the subpoena says,” she said of Iyer’s insistence that the document was a voluntary request. “It says command or else we’ll possibly go after your business license, or you’ll wind up [being charged] with contempt.

“Those are the death knell for nonprofits like First Choice.”

Even liberal Justice Elena Kagan seemed sympathetic to that concern.

“An ordinary person, one of the funders for this organization or for any similar organization, [who is] presented with the subpoena and then told, ‘But don’t worry, it has to be stamped by a court,’ is not going to take that as very reassuring,” she said.

A decision in First Choice Women’s Resource Centers, Inc. v. Platkin is expected by the end of June.

Suspect in DC shooting shouted ‘Allahu Akbar’ while firing gun: charging docs

 The gunman accused of shooting two National Guard troops stationed on the streets of Washington, DC, shouted “Allahu Akbar” as he fired his weapon — and appeared to be in the middle of reloading when he was shot and taken into custody, according to new court documents.

Rahmanullah Lakanwal, 29, an Afghan national who entered the US in 2021 following the US military pullout and worked on one of the CIA’s “Zero Units,” shot West Virginia National Guard members Specialist Sarah Beckstrom and Staff Sgt. Andrew Wolfe in the cowardly broad daylight attack.

Beckstrom, 20, died from her injuries on Thanksgiving Day, while Wolfe remains hospitalized in critical condition.

Lakanwal was charged with first-degree murder while armed in Beckstrom’s murder during a Tuesday hearing with DC prosecutors at his hospital bedside, where he’s being held under guard as he recovers from gunshot wounds.

A criminal complaint has not yet been filed in federal court, where US Attorney for the District of Columbia Jeanine Pirro has said they will seek the death penalty.

A chilling image taken from a surveillance video shows Lakanwal biding his time outside the Farragut West Metro Station just blocks from the White House, glancing to the west.

He stood there for “about a minute” before running in the direction of the intersection of 17th Street and I Street Northwest, according to charges filed in Washington, DC, Superior Court.

Another video shows Lakanwal turning the corner at the intersection with his hands raised “in a firing stance,” according to court documents, and firing rounds in the direction of Beckstrom and Wolfe, who both can be seen collapsing to the ground after being struck in the head, the affidavit said.

Upon hearing the gunfire, another West Virginia National Guard member, only identified in the affidavit as Complainant Reynolds, drew his service weapon and engaged in a gunfight with Lakanwal, who was shot and fell to the ground.

Reynolds said it appeared Lakanwal’s firearm was empty and that he was attempting to reload, at which point another National Guard Major, identified only as “W-1,” jumped on the terror suspect to subdue him.

Noem: Half of Minnesota visas ‘fraudulent,’ accuses ‘idiot’ Walz of doing it on purpose

 Homeland Security Secretary Kristi Noem revealed in Tuesday’s cabinet meeting with President Trump that half of all Minnesotans have submitted “fraudulent” visa applications.

“You told me to look into Minnesota and their fraud on visas and their programs: 50% of them are fraudulent, which means that that wacko Gov. Walz either is an idiot or he did it on purpose — and I think he’s both, sir,” Noem said, prompting chuckles in the room.

Noem also said those who submitted “fraudulent visa applications signed up for government programs, took hundreds of billions of dollars from the taxpayers and we’re going to remove them and get our money back.”

OpenAI's ChatGPT reports issues

 OpenAI said on Tuesday that its AI assistant ChatGPT is encountering issues, adding that it has applied mitigations and is monitoring the recovery.

The issue was first reported to have occurred at 3:12 pm ET, leading to increased error rates. Downdetector data also indicated some US users were experiencing problems with the chatbot.

Venezuela condemns Citgo's 'forced sale'

 The Venezuelan government on Tuesday rejected the US court-ordered sale of Citgo Petroleum Corporation, calling it a "forced sale" and a "vulgar and barbaric dispossession" of a national asset. Vice President Delcy Rodriguez (pictured) said the operation was carried out "to the detriment of Venezuela's interests."

She argued that Citgo, described as "a valuable asset of PDVSA, [Petroleos de Venezuela, SA]" is being "plundered by the US government through a procedure clearly contrary to the law." Rodriguez also claimed Caracas was excluded from the judicial process due to "US influence over its courts."

Days ago, a US federal judge endorsed Elliott Investment Management's roughly $6 billion bid for Venezuela's shares of Citgo, calling it the most reliable offer to close the sale. The decision pushes the forced sale of the company's prized asset closer to completion, pending OFAC approval.

Judge authorizes sale of Citgo parent to Elliott affiliate

 A U.S. judge authorized the sale of shares in the Venezuela-owned parent of oil refiner Citgo Petroleum to an affiliate of Elliott Investment Management, following his previous approval of a $5.9 billion bid from the company in a court-organized auction to pay Venezuela-linked creditors, Reuters reported

The sale order was the final legal step in a two-year auction aimed at paying creditors for debt defaults and expropriations in Venezuela.

Lawyers representing Venezuela, Citgo Petroleum and its parent companies filed appeals Monday before the Third U.S. Circuit Court of Appeals challenging last week's order that authorized the sale of PDV Holding's shares.

The transaction is pending approval from the U.S. Treasury Department, but Elliott affiliate Amber Energy has said it expects it to close next year.

Venezuela and rival bidder Gold Reserve (OTCQX:GDRZF) previously filed objections to Amber's bid and motions to disqualify the judge and advisors the court selected to evaluate the offers, which were denied by the judge.

If the deal is completed, companies including miner Crystallex and oil producer ConocoPhillips (COP) are set to recover billions from auction proceeds.
