Federal judge halts Biden admin’s rewrite of Title IX to include ‘gender identity’

 A federal judge has blocked the Biden administration’s attempt to rewrite Title IX to interpret “sex” as including all “gender identities,” which Republicans and conservatives charge would have allowed biological men to use women’s bathrooms and locker rooms.

Lexington, Ky. US District Chief Judge Danny Reeves ruled Thursday that the Education Department had exceeded its constitutional authority in issuing a rule that expanded the definition of “sex” for the purposes of filing discrimination complaints or letting people use restrooms corresponding to their “gender identity.”

“As this Court and others have explained, expanding the meaning of ‘on the basis of sex’ to include ‘gender identity’ turns Title IX on its head,” Reeves wrote.

There were also First Amendment concerns in implementing the rule, Reeves noted, given that it would compel people to use other pronouns for those selecting an alternative “gender identity.”

“Congress gave the [Education] Department authority to issue rules, regulations, and orders to effectuate Title IX’s prohibition on sex discrimination consistent with the objectives of the statute. However, the Department exceeded that authority in issuing the Final Rule and the text of Title IX shows why,” he said.

“Put simply, there is nothing in the text or statutory design of Title IX to suggest that discrimination ‘on the basis of sex’ means anything other than it has since Title IX’s inception — that recipients of federal funds under Title IX may not treat a person worse than another similarly-situated individual on the basis of the person’s sex, i.e., male or female,” he added.

Reeves, an appointee of former President George W. Bush, determined that the provisions challenged by more than a dozen GOP-led states were flatly unconstitutional, though the full rule also included other protections for handling claims of sex harassment and assault.

Republican attorneys general in Virginia, West Virginia, Ohio, Indiana, Kentucky and Tennessee had argued the rule, first introduced last April and implemented in August, undermined Title IX’s equal opportunity protections already in place for men and women.

The Education Department had already withdrawn a separate rule in December pushing for transgender athletes to compete on the team of their choosing.

In 2020, the Supreme Court determined in Bostock v. Clayton County that employees could not be discriminated against on the basis of “sex” to include their “gender identity,” but that only applied to Title VII of the Civil Rights Act of 1964.

Bill Cassidy (R-La.), who chairs the Health, Education, Labor and Pensions Committee. “With President Trump and a Republican majority in Congress, we will ensure women and girls have every opportunity to succeed on the field and in the classroom.”     

President-elect Donald Trump has promised to stop “transgender lunacy” once he takes office and make it the “official policy” of his second administration to only recognize two genders, male and female.

“With the stroke of my pen on day one, we’re going to stop the transgender lunacy,” Trump, 78, told supporters at AmericaFest 2024 in Phoenix, Ariz., last month.

“I will sign executive orders to end child sexual mutilation, get transgender out of the military and out of our elementary schools and middle schools and high schools,” he said, drawing cheers from the crowd.

Reps for the Department of Education did not immediately respond to a request for comment.

A designated terror group, Hizb ut-Tahrir, plans to host its annual Islamic supremacy conference in Mississauga, Ontario, on January 18, according to the Post Millennial. The event, focused on "eliminating obstacles delaying the return" of a global Islamic caliphate, was first reported by the Western Standard.

On Facebook, the group questioned, "Is America really so powerful that our Ummah can't defeat it?"

The post reads: "There have been superpower states in the past too, like the Romans and the Persians; yet, they were defeated by the Ummah. Their great cities, like Constantinople, are now Muslim cities."

It continues: "What steps do we need to take to become victorious against today's Colononialist superpowers? Learn what it will take for our Ummah to overcome America, Europe, Russia, China and others from the position we're in today. If you want to help create real change in our Ummah, then get this critical knowledge by attending, inshallah."

The controversial Hizb ut-Tahrir, aiming to establish a global Muslim state under Sharia Law, is designated as a terrorist group in numerous countries, including the UK, Germany, India, and Russia.

A Facebook post promoting its upcoming conference featured a video depicting a Muslim conquest. The event's location remains undisclosed, with details provided only to those registered via Eventbrite. The group is banned in most Arab and Central Asian nations, along with Indonesia, Pakistan, and several others.

Erik Prince Reveals Trump Was Closer To Buying Greenland Than Previously Known

 Blackwater USA founder Erik Prince revealed in a recent interview on the Sean Spicer Show that President-elect Donald Trump’s first administration was closer to securing a groundbreaking agreement with Denmark to take control of Greenland than previously known. Prince's comments come as Trump ramps up his calls to acquire the Arctic landmass, highlighting its strategic military and economic advantages.

SEAN SPICER: From a strategic standpoint how important is Greenland to the United States?

ERIK PRINCE: It is an enormous amount of mineral potential. It is of significant interest to the Chinese Communist Party. And so I think what Trump had proposed last time, last administration, was effectively a 50-50 rev share where the US would take over the overhead costs because it costs Denmark tens of billions of dollars a year for the policing, security, and administration of Greenland. The US would take that on, but then it would basically split the revenue of any mining or energy development together with Denmark. I think it's a good deal for Denmark and a good deal for the United States.

SEAN SPICER: Does Denmark view themselves right now as potentially being under attack by the Chinese or under threat from them?

ERIK PRINCE: No, but it's the same CCP approach of show up with a lot of money, buy a lot of influence, and create presence—literally in our attic—that the Canadian government doesn't do nearly as much of effective patrolling of all those waters and areas. And so, as a defensive play and as a good opportunity for the United States to maximize the reach and the economic development in our own hemisphere, it makes perfect sense. Most importantly, there's some fantastic back country and helicopter skiing.

SEAN SPICER: I knew there'd be a silver lining, but I mean in all honesty I just can't imagine Denmark saying oh yeah yeah we'll give up 50% or 20% even of our sovereign territory because you guys want.

ERIK PRINCE: They were almost ready to do the deal last time. Yes, and because Denmark—I don't believe Denmark doesn’t come anywhere near to the 2% that they’re supposed to be spending on NATO. Maybe it’s just a false flag by the president to make Denmark spend their 2% on NATO. But it's an interesting approach and I hope he sees it through.

SEAN SPICER: If you had to make a prediction whether Denmark agrees to some kind of a deal, where would you put it?

ERIK PRINCE: Above 50%. Remember, you know, think about, um, you know, they called the purchase of Alaska Seward's Folly and it turned out to be absolutely a brilliant purchase. I think it came out to two or three cents per acre in terms of value. Um, the United States, you can imagine, where would we be without Alaska? So maybe in five years or 10 years, we'll be looking back, where would we be without Greenland?

Climate Hustle: EPA Advisor Admits Sending Billions To Climate Groups Before Trump Takes Office

An Environmental Protection Agency (EPA) advisor has been caught on hidden camera admitting that the outgoing Biden administration is funneling billions of taxpayer dollars to climate organizations as a hedge against the incoming Trump administration.

Brent Efron who is a special advisor for implementation for the EPA, was recorded by Project Veritas bragging about sending tens of billions of dollars in grants to climate nonprofits as “an insurance policy” against Trump’s promises to rein in government spending.

Efron exhibits zero shame as he laughingly equates the frantic effort to get as much money as possible to climate-related allies as “throwing gold bars off the Titanic.”

When asked where that money is going, Efron responds, “Nonprofits, states, tribes,” explaining that the effort would continue, “until the Trump people come in and tell us we cannot give out money.”

Efron refers to the Inflation Reduction Act as “Biden’s climate law” and describes how the EPA uses aligned nonprofits to implement climate change policy at the local level because, “they’re safer from Republicans taking the money away.”

Efron also describes how he and his colleagues will likely continue working right up until Trump is inaugurated in order to push out as much money as possible to climate allies.

He’s also considering how his efforts to loot the treasury on behalf of these climate nonprofits could translate into a cushy job with one of them when the new administration takes over.

The outgoing Biden administration hasn’t been shy about shoveling as many taxpayer dollars as possible to its favored friends and lobbyists before President-elect Trump can take office on Jan 20.

The Project Veritas report prompted a pointed response from Sen. Mike Lee (R-UT) who described Washington as having become empowered to the point that it’s become “dangerous and destructive,” and calling for a return to constitutional government.

GSK bags breakthrough status for bone cancer drug

 GSK has claimed its second breakthrough designation from the FDA for antibody-drug conjugate GSK5764227, which it licensed from China's Hansoh Pharma in a $1.7 billion deal.

The status has been given to the B7-H3-targeted drug as a treatment for late-line relapsed or refractory osteosarcoma, a rare form of bone cancer with no FDA-approved treatments.

The coveted status can help speed up the development and regulatory review of drugs with the potential to treat a serious condition and where preliminary clinical evidence may indicate substantial improvement over currently available therapy.

The FDA previously designated the ADC as a breakthrough drug for relapsed or refractory extensive-stage small-cell lung cancer (SCLC), with the EMA awarding Priority Medicine (PRIME) status to the drug for this use last year.

B7-H3, also known as CD276, is an immunoregulatory protein that is overexpressed in tumour tissue, notably in lung, breast, ovarian, gastric, and brain cancer, as well as squamous cell carcinoma of the skin. It has limited expression in normal tissues, making it an interesting target for therapy that could avoid off-target side effects.

GSK said that the osteosarcoma designation is supported by data from the phase 2 ARTEMIS-002 study, an open-label trial that is evaluating GSK'227 in patients with relapsed or refractory osteosarcoma and other unresectable bone and soft tissue sarcomas, which is being conducted by Hansoh in China.

Initial results from the study reported at last year's ASCO cancer congress showed a 20% overall response rate with the ADC and a disease control rate – which includes stabilisation of the cancer – of up to 100%. GSK started an international phase 1 trial of the drug last summer.

Osteosarcoma mainly affects children and young adults and is the most common primary bone cancer, accounting for 20% to 40% of all bone cancers, according to GSK. Classed as a rare disease, it has an annual incidence of 3.3 patients per million in the US, representing less than 1% of all new cancer diagnoses.

At the moment, the first-line treatment is generally chemotherapy, with limited options for patients who don't respond or subsequently relapse.

GSK licensed rights to GSK'227 outside China, Hong Kong, Macao, and Taiwan in December 2023 for $185 million upfront and another $1.525 billion is potential milestone payments. A few weeks earlier, it tapped the Chinese biotech for a B7-H4 targeted ADC with potential in gynaecological cancers for $85 million upfront and up to $1.5 billion in milestones.

MSD and Daiichi Sankyo are currently at the forefront of drugmakers developing B7-H3-directed therapies, as they have already started phase 3 testing of their ifinatamab deruxtecan (I-DXd) ADC in patients with previously treated, extensive-stage SCLC.
