Bayer files suit against J&J on false advertising

 Bayer AG said on Monday that it filed a lawsuit against Johnson & Johnson (J&J) and Janssen Biotech, accusing J&J of using flawed science to make false claims about its drug, ERLEADA®, to hurt sales of Bayer's drug, NUBEQA®.

Bayer argues that J&J is spreading misinformation to doctors and patients. It claims J&J's data analysis is deeply flawed. For example, the study did not compare the drugs properly. Most patients using NUBEQA® were taking it for unapproved uses. Also, the study period was too short to be reliable.

Bayer states that only proper clinical trials can prove a drug is better. It also asked the United States District Court for the Southern District of New York to stop J&J's promotion and to receive money for damages.
