ReShape: Notice of Allowance for U.S. Patent Related to its Obalon® Balloon System
ReShape Lifesciences™ (Nasdaq: RSLS), the premier physician-led weight loss and metabolic health solutions company, today announced that the company has received a Notice of Allowance from the U.S. Patent and Trademark Office (USPTO) for patent application 16/792,094, entitled, “Systems and Methods for Determining Failure of Intragastric Devices,” related to its Obalon® Balloon System. The patent will cover additional claims for the Obalon® Balloon System and is expected to provide protection into at least January 2031, without accounting for a potential Patent Term Extension (PTE).

Rumors of Acquisition Surrounding Aldeyra
As of April 11, 2023, word on the street is that a significant pharmaceutical company has its sights set on acquiring Aldeyra Therapeutics, a biotech firm specializing in immune-mediated disease treatments. While Aldeyra recently wrapped up its Phase 2 clinical trial of an orally administered RASP modulator, there has been no official word on the acquisition rumor. The company only proposed a public offering of common stock in February of this year.

Akebia Adjourns Special Meeting of Stockholders
Meeting adjourned to Thursday, May 4, 2023 at 10:00 a.m. Eastern Time
Akebia Therapeutics, Inc. (Nasdaq: AKBA), a biopharmaceutical company with the purpose to better the lives of people impacted by kidney disease, today announced that it adjourned, without conducting any business, the special meeting of stockholders (the "Special Meeting") on Tuesday, April 11, 2023 to allow the company to solicit from its stockholders the additional proxies necessary to obtain approval of the proposals described in the company's revised definitive proxy statement filed with the Securities and Exchange Commission on March 17, 2023.
The Special Meeting will reconvene on Thursday, May 4, 2023, beginning at 10:00 a.m. Eastern Time at www.virtualshareholdermeeting.com/AKBA2023SM. The record date for the Special Meeting continues to be the close of business on February 16, 2023. No changes have been made to the proposals to be voted on by stockholders at the Special Meeting. Akebia encourages all stockholders of record at the close of business on February 16, 2023 who have not yet voted, to vote by 11:59 p.m. Eastern Time on May 3, 2023.
Akebia's board of directors strongly recommends that stockholders vote "FOR" each of the proposals presented at the Special Meeting.

Moderna fends off Arbutus appeal in COVID-19 vaccine patent fight
A U.S. appeals court handed Moderna Inc a win on Tuesday, affirming a decision to cancel an Arbutus Biopharma Corp patent related to the companies' legal fight over Moderna's blockbuster COVID-19 vaccines.
The U.S. Court of Appeals for the Federal Circuit upheld a U.S. Patent and Trademark Office tribunal's ruling that the patent for Arbutus' lipid nanoparticle (LNP) technology was invalid based on an earlier Arbutus patent that disclosed the same invention.
Moderna challenged the patent at the PTO's Patent Trial and Appeal Board in 2018, and the board invalidated it in 2019.
A spokesperson for Genevant declined to comment on the Tuesday decision. A Moderna spokesperson said the company was pleased with the ruling.
The Federal Circuit's decision does not affect an ongoing lawsuit filed by Arbutus and Genevant Sciences — a joint venture between Arbutus and Roivant Sciences Ltd — against Moderna last year in Delaware for allegedly infringing other related LNP patents.
Warminster Township, Pennsylvania-based Arbutus said in the lawsuit that Cambridge, Massachusetts-based Moderna began challenging its patents at the PTO after failing to acquire a license to its LNP technology.
The technology is used to deliver RNA to target cells without being attacked by the body's immune system.
Arbutus separately sued Pfizer and BioNTech for patent infringement last week over their COVID-19 shots, in a lawsuit that also does not include the canceled patent.
