The US Department of Justice (DoJ) ruled on Wednesday that states must report known undocumented immigrants to the Department of Homeland Security (DHS) or risk losing federal funding for programs supporting low-income individuals.
"When a state chooses to participate in TANF (Temporary Assistance for Needy Families), it accepts the obligation to report illegal aliens in the United States. Tax dollars intended to help vulnerable Americans should not perversely encourage illegal entry into the United States, but rather should reinforce our laws and our borders," Assistant Attorney General Elliot Gaiser of the DOJ’s Office of Legal Counsel, said in a statement.
The DOJ's new legal opinion revised a 1998 Office of Legal Counsel opinion, which said only state agencies administering TANF and Supplemental Security Income were required to share information with federal immigration authorities.
