'Strange legal move by Manhattan DA Bragg led to Daniel Penny acquittal'

A strange legal move last week by Manhattan prosecutors ultimately led to the acquittal of Daniel Penny on Monday, legal pros told The Post.

The move to dismiss the top charge of manslaughter against Penny, 26, in the May 2023 subway chokehold death of Jordan Neely backfired spectacularly on prosecutors in Manhattan District Attorney Alvin Bragg’s office, attorneys said.

“To say that as a tactical matter, the DA botched their analysis here is an understatement,” said former Manhattan prosecutor Mark Bederow, who called the case “a failure of prosecutorial discretion.”

"I don’t think there was ever a situation in which a jury of 12 Manhattan subway riders was going to convict a US Marine who came to the aid of riders who were being threatened by an unstable man,” Bederow, now a defense attorney, said.

Prosecutors on Friday had rejected calls for a mistrial from Penny’s legal team after the jury was hopelessly deadlocked on the manslaughter rap, which carries a maximum sentence of 15 years in prison.

Instead, they begged Manhattan Supreme Court Justice Maxwell Wiley to sign off on a request to throw out the top charge and have the jury continue deliberating on the lesser charge of criminally negligent homicide, which carried a maximum of four years in prison.

“I’ll take a chance and grant the people’s application,” the judge said on Friday. “Whether that makes any difference or not, I have no idea. But I’m going to direct you to focus your deliberations on count two.”

The move drew a sharp rebuke from Penny’s lawyers, who argued it could “coerce” the jury into a “compromise” verdict.

But it was Penny who came out on top in the end. 

According to legal experts, Wiley’s ruling is not unprecedented, but rare.

“I’ve never seen it while a jury is deliberating,” said former Brooklyn prosecutor and current criminal defense lawyer, Julie Rendelman, “and after a jury has come back with being hung on the top count.”

Rendelman also said the move could impact future criminal cases, with prosecutors possibly over-charging “even if, arguably, the evidence wasn’t there” and then pointing to the Penny trial and moving to dismiss the counts if they see their cases are failing.

“What we saw here,” Rendelman told The Post, “is that they were like ‘eh, I guess it didn’t work the way we wanted, so let’s pretend [the top charge] doesn’t exist.’

“I’m sure the prosecution had hoped that dismissing the top count would result in a conviction for criminally negligent homicide,” Rendelman added following the jury’s verdict to acquit. “Clearly that was not the case. One does have to wonder what exactly the jury was hung up on with the manslaughter charge, given the ultimate acquittal.” 

Arthur Aidala, former Brooklyn prosecutor turned criminal defense lawyer, said he believes not only did the DA’s office make a blunder, the judge did, too.

“When you send jurors home over the weekend, it’s not that rare that when they come in after having relaxed and cleared their head, that they come in with a little bit of a different mindset — and maybe that’s what happened here today,” Aidala told The Post.

“I think it came down to the term ‘reasonableness,’” citing the last note the jury passed to the judge on Friday.

“Was it reasonable for Penny to act the way he did to have the fear that he did, for himself or a third party, regarding self-defense? And I guess once they took manslaughter in the 2nd degree off the table, they pretty swiftly reached a verdict regarding criminally negligent homicide.”

Aidala says he suspects that some jurors were persuaded by Penny’s self-defence claims, leading to the hang-up on the manslaughter charge last week. 

“Only those jurors really know what took place in that room,” he said, “but I think you have to think that the self-defense claim worked here.”

He also agreed with Rendelman that this could set a precedent in other cases.

“What Judge Wiley set up is, for in the future, prosecutors to overcharge a case, and if the jury gets hung up on that top charge, well the prosecutors will just move to dismiss the top charge and then try to get a decision on the lower charge,” Aidala said. “So it gives them almost two bites at the apple. That’s why, in all the research everyone’s done, we’ve never seen a situation in Manhattan where a judge has allowed a prosecutor to dismiss the top count while the jury’s deliberated”

When asked about the future of Bragg, who defeated rival, and Penny lawyer, Thomas Kenniff in a landslide during the 2021 general election, Aidala said “I would think he would be vulnerable.”

“I don’t know why someone hasn’t run against him,” Aidala said. “There’s some issues that in a debate, he could be attacked.”

 A Black Lives Matter activist called on “black vigilantes” to avenge Jordan Neely’s death immediately following Daniel Penny’s acquittal Monday

“People want to jump up and choke us and kill us for being loud, how about we do the same when they attempt to oppress us,” Walter ‘Hawk’ Newsome, a BLM leader who describes himself as Jordan Neely’s uncle and was in the courtroom every day of the trial, said outside the Manhattan courthouse. 

“Just like everybody else seeks justice on their own. Just like everybody else has vigilantes. We need some black vigilantes,” he told reporters and protesters who had turned out daily in support of Neely during the weekslong trial.

“F—k America. How dare you laugh and cheer when someone gets away with murdering us,” Newsome added, apparently referencing the applause that erupted in the courtroom after the verdict. “Racists: burn in hell.”

Jordan Neely’s father also addressed the crowd, lamenting the watershed verdict. 

“My son didn’t have to go through this. I didn’t have to go through this either,” a dejected-looking Andre Zachary told reporters. “It hurts. It really, really hurts.”

“What are we gonna do, people? What’s gonna happen to us now? I had enough of this,” Zachary said. “The system is rigged. C’mon, people. Let’s do something about this.”

Inside the courtroom, Zachary had to be escorted out while jawing at the audience as applause erupted when the jury announced it had found Penny not guilty of criminal negligent homicide in Neely’s death on a Manhattan F train in May 2023.

The distraught father immediately got into a shouting match with someone behind him.

He appeared to have yelled, “You clapping when my son got f—ing killed.”

Court officers quickly moved in, telling Zachary, “Out, out — you’re out.”

The highly-charged and divisive case took a turn last week when Manhattan Supreme Court Justice Maxwell Wiley agreed with a prosecution request to drop the top manslaughter charge against Penny, a 26-year-old Marine vet, and consider only the lesser negligent homicide charge.

The jury returned the not guilty verdict on Monday.

“The jury has now spoken,” Manhattan District Attorney Alvin Bragg said in a statement. “At the Manhattan D.A.’s Office we deeply respect the jury process and we respect their verdict.”

Penny, 26, claimed he grabbed a deranged Neely and put him in a chokehold to protect other passengers after the 30-year-old yelled, “Someone’s going to die today!”

Zachary sued Penny last week, accusing him of negligent contact, assault and battery leading to the death of his son. 

The suit, filed in New York Supreme Court, said Zachary “demands judgment awarding damages in a sum which exceeds the jurisdictional limits of all lower Courts which would otherwise have jurisdiction.”

Israel Striking Bases & Equipment Across Syria, Including Assad’s Chemical Weapons Sites

 Israeli warplanes in the last several hours have been conducting major airstrikes against facilities across Syria, just 48 hours after the Assad government's fall and the entrance of Al-Qaeda linked militant factions into Damascus.

"At least two explosions heard in Damascus have taken place in the area of Barzeh, north of Damascus, where the Syrian Scientific Studies and Research Centre has an office," several eyewitnesses have told Reuters.

"The SSRC has been sanctioned and previously struck for its links to chemical weapons production under toppled Syrian President Bashar al-Assad," the report continues. It is a location that Israel first struck all the way back in 2013, and has hit on several occasions since then.

Sensitive military facilities formerly belonging to the Syrian Army and now defunct Assad defense ministry have also been destroyed by Israeli attacks across the south of Syria on Monday.

A weapons warehouse near the Damascus international airport, which has ceased operations, has also been hit. Massive strikes have been reported on Latakia port as well, which giant fireballs lighting up the night sky.

Amid the chaos of the HTS takeover of the country over the last week, and before any type of new government can coalesce in Damascus, it appears Israel is preemptively taking out all military technology and heavy weaponry before anyone else can access it

An Israeli broadcast correspondent from Kann writes that "An Israeli source tells me: Israel's goal is to destroy everything from Assad's army that could fall into the hands of the rebels - from tanks to missiles. We are destroying the equipment of the Assad army."

Israel has also expanded its penetration into historic Syrian territory in the south:

After fighting wars on multiple fronts for months, Israel is now concerned that unrest in Syria could spill over into its territory. Israel also views the end of the Assad regime as a chance to disrupt Iran’s ability to smuggle weapons through Syria to the Lebanese militant group Hezbollah.

The Israeli military over the weekend began seizing control of a demilitarized buffer zone in Syria created as part of a 1974 ceasefire between the countries. It said the move was temporary and meant to secure its border.

But the incursion sparked condemnation, with critics accusing Israel of violating the ceasefire and possibly exploiting the chaos in Syria for a land grab.

Indeed 'exploiting' the situation for a land grab is precisely what the game plan has likely been from the start, as both Israel and Turkey are the big winners in the Syria crisis, and with Assad gone (having been given asylum in Moscow).

According to more details of what's been hit in the ongoing Israeli attacks:

New Israeli airstrikes are reported in Syria, targeting an airbase near the capital Damascus.

Al Jazeera reports that the Qabr Essit Airport, used by the ousted Assad regime’s army for helicopters, was hit in the strikes. The airbase is located south of Damascus, close to the town of Aqraba.

Some reports are saying that as many as 100 sites have been struck in the last 12-24 hours, but more is likely to be confirmed when the dust settles. Jets and aerial equipment, and runways at bases are being obliterated.

Part of Israel's aim also seems to be preventing pro-Iranian entities from ever popping up again in Syria, and to finally and definitively dismantle Hezbollah and Shia militias' arms networks.

Sunni hardline factions are also a feared element, given they could eventually turn the same weapons against Israel, and in the Golan Heights area, and as Israeli troops continue invading the south for a so-called buffer zone.

'Here Comes The "Disease X" Outbreak'

 A mysterious illness in the Democratic Republic of Congo has been dubbed "Disease X." There have been over 400 cases and up to 143 deaths linked to the illness since late October, according to Bloomberg

On Sunday, the World Health Organization provided an update on Disease X, indicating the illness has been reported in the Kwango Province, in the southwest part of the Central African country. 

"Panzi health zone in Kwango Province of Democratic Republic of the Congo recorded 406 cases of an undiagnosed disease with symptoms of fever, headache, cough, runny nose and body ache," the WHO wrote in the disease outbreak report. 

The report continued:

"Rapid response teams have been deployed to identify the cause of the outbreak and strengthen the response. The teams are collecting samples for laboratory testing, providing a more detailed clinical characterization of the detected cases, investigating the transmission dynamics, and actively searching for additional cases, both within health facilities and at the community level."

WHO noted:

"Malaria is a common disease in this area, and it may be causing or contributing to the cases. Laboratory tests are underway to determine the exact cause. At this stage, it is also possible that more than one disease is contributing to the cases and deaths." 

According to Bloomberg data, the total number of headlines in corporate media featuring "Disease X" last week topped 69, the highest since February, when it was about 127. Notice over the years, including early 2020, when Disease X headlines spiked. 

Data from X also shows a surge in "Disease X"-related posts in recent days. 

The cause of Disease X remains unknown and comes just as President-elect Trump is set to re-enter the White House next year.
