'Johnson & Johnson to Return to Tort System to Defeat Meritless Talc Claims'

Today, the U.S. Bankruptcy Court for the Southern District of Texas denied the request by Johnson & Johnson (NYSE: JNJ) (the "Company") subsidiary Red River Talc LLC ("Red River") to confirm its proposed prepackaged bankruptcy plan—notwithstanding that it offered one of the largest settlements ever proposed in a mass tort bankruptcy and was supported by the overwhelming majority of claimants.

Rather than pursue a protracted appeal, the Company will return to the tort system to litigate and defeat these meritless talc claims. The disclosures made under oath in the Red River bankruptcy affirmed that the talc litigation is a plaintiff-lawyer driven fake tort, premised on junk science and fueled by third party litigation financing including from foreign sovereign wealth funds. Consequently, the Company has no intent to settle or pay plaintiff lawyers on such meritless claims. Accordingly, the Company will reverse approximately $7 billion of the previous reserve.

"The Court has unfortunately allowed a couple of law firms with financially conflicted motives, who have conceded they have not recovered a dime for their clients in a decade of litigation, to defeat the overwhelming desire of claimants. As we have repeatedly stated, in the absence of plan confirmation, we will vigorously present our case in the tort system, starting with the adjudication of the motions pending in the Multi-District Litigation to exclude plaintiffs’ experts and to disqualify the lead counsel for its unethical breaches. In view of the learnings from the bankruptcy case, we are more confident than ever in our position in the tort system," said Erik Haas, Worldwide Vice President of Litigation, Johnson & Johnson. "We prevailed in 16 of 17 ovarian cases tried in the last 11 years and will devote our efforts to defeating these fake claims."

The Company has already made great strides in resolving its talc litigation by settling 95% of filed mesothelioma lawsuits, concluded all State consumer protection claims, as well as all talc-supplier disputes.

"Today’s decision highlights the broken tort system in the United States. The Company reiterates that none of the talc-related claims against it have merit and attempts to resolve this litigation were aimed at moving past this issue," said Mr. Haas. "The decision to litigate every filed case is based on the simple fact that this is a fake claim created by greedy plaintiff lawyers looking for another deep pocket to sue and fueled by litigation-financed attorney advertising."

Shares of Hong Kong conglomerate CK Hutchison climbed 1% on Tuesday ahead of a deal to sell its Panama ports to a BlackRock-led group that is due to be signed by April 2.

TG Natural Resources Buys Majority Stake in Chevron East Texas Gas Assets, Strengthens Haynesville Play

TG Natural Resources LLC (“TGNR”), a company indirectly owned by Tokyo Gas Co., Ltd. (“Tokyo Gas”) and Castleton Commodities International LLC (“CCI”), announced that it has closed on a transaction to acquire a 70% interest in the East Texas gas assets of Chevron U.S.A. Inc., a subsidiary of Chevron Corporation (“Chevron”), for $525 million, with $75 million paid in cash and $450 million as a capital carry to fund Haynesville development, prior to customary adjustments (the “Transaction”).

With this transaction, TGNR will add over 250 gross locations to its existing Haynesville inventory (assuming four wells per section). This will extend TGNR’s inventory life beyond 20 years at the current development pace, not counting the Bossier and Cotton Valley plays which are commercial at current prices. The Haynesville acreage in this transaction is relatively undrilled and held by shallower production, allowing parent-child effects between wells to be mitigated.

Craig Jarchow, CEO of TGNR said, “We are excited to partner with a world-class company like Chevron on this transaction. There is considerable operational overlap between the Chevron acreage and the legacy TGNR acreage, which will allow TGNR to realize synergies of over $170 million during the development of the asset.”

Musk: 'Mind blowing' chart shows millions of 'noncitizens' given Social Security numbers under Biden

Elon Musk shared a chart during a get-out-the-vote rally in Wisconsin over the weekend, which he claimed showed millions of noncitizens received Social Security numbers during former President Joe Biden's tenure.

The event came just a day-and-a-half before polls opened in a contentious state judicial race.

The Sunday town hall garnered a lot of attention Monday over Musk's move to hand out $1 million checks to two Wisconsin voters who signed a petition calling for an end to "activist judges," after the state's Supreme Court declined to take up a challenge arguing the sweepstakes was unlawful.

After handing out the money, Musk brought friend and DOGE colleague Antonio Gracias on stage to discuss the work he has done with the federal government's Social Security system. Shortly after Gracias joined Musk, a large graphic that read, "New Non-Citizen Social Security Numbers Issued," was illuminated on the screen behind them.

"We started at the top of the system, mapping the whole system of Social Security to understand where all the fraud was," Gracias said, before turning his attention to the chart behind him. "But, this is what jumped out at us," he continued. "When we saw these numbers, we were like, ‘What is this?’"

Gracias was referring to the total number of noncitizens who received Social Security numbers between FY 2021 and FY 2025. The chart showed a steady year-over-year increase under Biden, reaching more than 2 million in FY 2024, which ended on Sept. 30.

FY23 saw roughly 1 million noncitizens issued Social Security numbers, as did FY25, which began in October and will end in September of this year.

"This literally blew us away," Gracias said. "We went there to find fraud and we found this by accident."

"This is a mind-blowing chart," Musk added.

Elon Musk's DOGE efforts at the Social Security Administration have uncovered that roughly 7 million accounts belong to folks listed as older than 120, and roughly 20 million are registered to people who are deceased. (Getty)

The eyebrow-raising numbers come amid Musk and DOGE's ongoing probe into various federal programs and agencies, including the Social Security Administration (SSA).

Last week, DOGE said it had removed approximately 7 million Social Security accounts belonging to people listed as being over 120 years old. DOGE has also found through its audits that the Social Security database included 20 million dead people marked as alive, Musk said at the Wisconsin town hall Sunday.

Shortly after taking office, President Donald Trump signed an executive order directing all public assistance and social services in the U.S. to stop providing access to noncitizens, stating such services are intended for U.S. citizens.

In line with the president's directive, the Department of Housing and Urban Development launched a new initiative last week with the Department of Homeland Security that seeks to bolster inter-agency communication between the two departments to ensure noncitizens are not benefiting from public housing programs.

NY bill would force bad drivers to install speed limit tech in cars

Two state lawmakers are pushing a bill to force bad drivers to install tech on their cars that would stop them from going faster than 5 mph above the speed limit.

The proposed law would target reckless drivers who either rack up at least six speed or red light camera tickets in a year or get 11 points on their licenses over two years, its sponsors said at a news conference at Brooklyn Borough Hall on Monday — two days after a disturbing Brooklyn crash that took the lives of a mother and her two children

“The driver who took their lives, had 21 speeding tickets in the last two years – had six red light camera violations in the last six months and had 70 plus other violations in the last two years and was still able to get behind the wheel of a vehicle,” state Sen. Andrew Gounardes said of the driver Miriam Yarmini.

Gounardes said the tech could’ve prevented the tragedy as he and others called to advance the bill, cosponsored with fellow Democrat Assemblywoman Emily Gallagher and first introduced in late January.

The tech – which operates similarly to breathalyzer ignitions –  is known as intelligent speed assistance technology, and is being installed in virtually all new cars sold in the European Union.

Virginia became the first US state to pass similar legislation earlier in the month to stop dangerous drivers, and New York state has already tested the technology thoroughly.

“New York City did a pilot of 500 vehicles and they found that every single vehicle was able to drive within the limit and it did not impede the delivery of city services,” Gounardes explained.

One concern among proponents for road safety is that he proposed law does not allow cars to be impounded for repeated speeding offenses. Under laws today, cars in NYC can only be impounded if the driver has acquired $350 or more in parking or red light camera tickets.

City Comptroller Brad Lander, who attended Monday’s news conference, had backed law as a City Council member coined the “Reckless Driving Act” in 2018 that gave the government power to seize cars from repeat speeders.

In 2022, the Adams administration let it expire.

“We passed (the act) in New York City to give us the power to impound the cars of reckless drivers, but unfortunately, that legislation was allowed to expire, and would have applied to this car,” said Lander, who is running against Adams in a Democratic Party primary for mayor in June. “So we are heartbroken, and we’re angry.”

Republican Assemblyman (R-45) Michael Novakhov said he wouldn’t back the bill because six violations aren’t enough.

“What I don’t like about the bill is it says six red-light or speed violations in one year [triggers the installation of the speed-limiting device]. I think this is too little,” Novakhov told Streetsblog.

“Any driver can get much more than six … Sometimes you don’t see the camera. Sometimes there are situations where you have to speed up a little bit. To be honest with you, I’m against the cameras because we have too many.

Gournardes and Gallagher are fighting to get the bill passed in this legislative session, which goes until June.
