California Gov. Gavin Newsom signed an executive order Sept. 18 directing state agencies to accelerate implementation of the state’s new AI oversight laws and to explore requiring frontier AI developers to build an emergency shutoff, or “kill switch,” into their models.
The order directs the Government Operations Agency to speed up timelines for Senate Bill 813 and Assembly Bill 1405, two laws Mr. Newsom signed Sept. 9 that create a certification framework for independent organizations to audit AI systems and a state registry for AI auditors.
The agency, working with the Governor’s Office of Emergency Services, will convene national experts within two months to recommend further changes to state law. Under consideration: requiring independent verification organizations to be embedded onsite at frontier AI labs, mandating third-party verification of AI safety frameworks and risk assessments already required under state law, and updating the definition of “critical safety incident” to include loss-of-control events such as the recent Hugging Face attack.
“We’re not waiting to act — we’re going to speed up our work on substantial and responsible AI oversight before it’s too late,” Mr. Newsom said in a news release.
The order builds on California’s 2025 frontier AI transparency law, SB 53, and follows Mr. Newsom’s call for Congress and President Donald Trump to adopt the state’s AI framework as a national baseline. For hospitals and health systems deploying AI clinical and administrative tools built by frontier model developers, the move signals tighter audit and incident-reporting requirements ahead.
