Viatris filed a lawsuit against Novo Nordisk in Delaware federal court, requesting a determination that its planned generic version of Wegovy would not violate the Danish company's patent rights.
Mylan Pharmaceuticals, a Viatris unit, asked the court Thursday to rule that its generic product would not infringe Novo Nordisk's patent for a method of administering single-dose Wegovy pens for weight loss.
Novo Nordisk generated nearly $31 billion from its semaglutide-based weight loss medications Wegovy and Ozempic last year, according to company reports.
Generic versions of Wegovy and Ozempic cannot enter the U.S. market until 2032, when Novo Nordisk patents covering semaglutide, the drugs' active ingredient, expire.
Novo Nordisk has previously settled patent lawsuits over proposed Wegovy and Ozempic generics with Mylan and other drugmakers.
